Kim Zolciak Breaks Silence on Latest Custody Setback With Kroy Biermann

Kim Zolciak is responding after a new court ruling in her ongoing divorce from Kroy Biermann granted him expanded authority over key decisions involving their children.

According to the latest development, a judge approved Biermann’s emergency request related to custody of their four minor children. While both parents will continue to share joint legal custody, Biermann has been given final decision-making authority on major issues, including non-emergency medical care, education, and religious upbringing.


Kim Zolciak Calls Custody Decision ‘Temporary’

The former “Real Housewives of Atlanta” star addressed the ruling in a statement to The Daily Mail and in social media posts, emphasizing that the order is not permanent.

“The senior judge’s (a ‘retired’ judge) decision from April 29th is temporary until we return to court as soon as possible when we have the opportunity for a full hearing,” Zolciak said.

She also claimed the outcome stemmed from Biermann’s emergency motion and criticized the process behind the ruling.

“She claims the decision was the result of a ‘flawed investigation’ by a guardian ad litem who has not spoken to her in over a year,” Zolciak said.

“While I want this process to be over for my children more than anything, I am looking forward to a full court date when we will finally be provided with an opportunity to present the truth,” she added.

Despite the change in decision-making authority, the former couple will continue to follow a shared parenting schedule, splitting time between households.


The Former RHOA Star Previously Addressed Custody and Co-Parenting Challenges

In early April, the former Bravo star addressed her custody arrangement on social media, clarifying that she had not lost custody of her children.

“For the avoidance of any doubt, I have not lost custody of my children, nor has there been any modification to the custody arrangement outside of the agreed-upon temporary order,” she wrote on Instagram.

She explained that a temporary agreement required both parents to attend counseling sessions, though work commitments made it difficult for her to attend at certain times.

“I signed a temporary order at the end of January,” Zolciak wrote. “That order clearly states that both the mother and father are to participate in two counseling sessions per month for two months, followed by one session per month thereafter.”

Zolciak also noted that Biermann had parenting time during spring break, with her scheduled to resume time with the children afterward.

The custody dispute follows a series of public accusations from both sides. Biermann has accused Zolciak of being “unstable and unfit,” while Zolciak has alleged that Biermann is attempting to “destroy her.”


Kim Zolciak Says Co-Parenting Has Been ‘Impossible’

Zolciak has previously spoken about the challenges of co-parenting with Biermann, including during an appearance at BravoCon 2025.

“I wish that we could co-parent. I don’t have any problem with my ex, Kroy. I don’t have any issues, I never have,” Zolciak said.

She added, “I just want what’s best for my kids, and unfortunately, I’m willing to do whatever it takes, and I’ve tried so many different avenues and different ways that we could co-parent, but it’s impossible.”

Zolciak also addressed the status of their divorce during a July 2025 appearance on “Watch What Happens Live with Andy Cohen.”

“The rug was pulled out from underneath me,” she said of the split, adding that communication between the two has been limited. “I would prefer to communicate more regarding the children, but it’s just not there right now.”
